Limited Warranty for Solar PV System
1. Limited Product Warranty – Five Years Repair, Replacement or Refund Remedy
Jiangyin Shine Science and Technology Company assure our customers that our photovoltaic solar modules including factory-assembled DC connecters and cables are not defective in materials and workmanship under normal application, installation and service conditions. If MODULES fail to conform to this warranty, within sixty months from date of sale as shown in the invoice to the direct customer of SHINE, SHINE will either repair or replace the module, or refund your money, at its option. The repair or replacement or refund remedy provided herein is the sole and exclusive remedy offered under the "Limited Product Warranty" and shall not extend beyond the sixty months period set forth herein. It will be performed directly to the CUSTOMER only. This "Limited Product Warranty" does not warrant a specific power output, which shall be exclusively covered under Limited Peak Power Warranty hereinafter.

2. Limited Peak Power Warranty – Limited Remedy
10 year
If any MODULE offers a power output less than 90% of the minimum "Peak Power at SHINE DATASHEET" as specified at the date of invoice in our Product Information Sheet, within a period of 10 years from the date shown on the invoice to the CUSTOMER, and such loss in power is verified to be due to defects in material or workmanship, SHINE will compensate for such loss in power by either providing additional MODULES to the CUSTOMER to make up for such loss in power or replacing the defective MODULES, at the option of SHINE.

25 year
If any MODULE with a Nominal Power of at least 25 Wp offers a power output less than 80% of the minimum "Peak Power at SHINE DATASHEET as specified at the date of invoice in our Product Information Sheet, within a period of 25 years from the date shown on the invoice to the CUSTOMER, and such loss in power is verified to be due to defects in material or workmanship, SHINE will compensate for such loss in power by either providing additional MODULES to the CUSTOMER to make up for such loss in power or replacing the defective MODULES, at the option of SHINE. The remedies listed in this clause 2 can only be provided under the "Limited Peak Power Warranty".

Notice
Peak Power is the power in watt peak that a PV- module generates in its maximum power point.
"STC" are as follows
1. Light spectrum of AM 1.5,
2. An irradiation of 1,000W per m2
3. A cell temperature of 25 degree Centigrade.
The measurements are carried out in conformity with IEC61215 as tested at the junction box terminals per the calibration and testing standards of SHINE, valid at the date when PV-modules are manufactured. Our calibration standards are in accordance with the relevant standards applied by international institutions.

3. Exclusions and Limitations
3.1 In any event, all the warranty claims must be filed within the applicable warranty period.
3.2. Our "Limited Product Warranties" and the "Limited Peak Power Warranties" are inapplicable when solar panels are subjected to
3.2.1 Misuse, abuse, neglect or accident,
3.2.2 Alternation, improper installation or application,
3.2.3 Non-observance of SHINE’s installation and maintenance instructions,
3.2.4 Repair or modifications by someone other than an approved service technician of
SHINE Science and Technology Company,
3.2.5 Power failure surges, flood, fire, accidental breakage or other events out of our control,
3.3. The transportation charge, customs clearance or other costs caused by installing, uninstalling, returning, reshipping, repairing or replacing solar panels should be borne by you.
3.4. Please be sure that the type or serial number of PV SOLAR PANELS have not been altered, removed or made illegible, or else, we will not honor the warranty clam.

4. Limitation of Warranty Scope
These "Limited Warranties for PV Modules" listed herein are expressly instead of and exclude all other express or implied warranties, including warranties of merchantability and of fitness for particular purpose or application, and all other obligations or liabilities we should be responsible for, unless these other obligations or liabilities are agreed by SHINE in writing form. SHINE shall not be responsible for damage or injury to persons or property, or for other loss or injury resulting from any cause arising from or related to the MODULES, including any defects in the MODULE, or from use or installation. In no case shall SHINE be liable for incidental, consequential or special damages. Loss of use, loss of production, loss of profits, loss of revenues are therefore specifically but without limitation excluded.
Our aggregate liability for a SOLAR PANEL, if any, in damages or otherwise, shall not exceed the invoice value as paid by the CUSTOMER.

5. Obtaining Warranty Performance
If the CUSTOMER needs to lodge a justified claim covered by this "Limited Warranties for PV Solar panels", please file an immediate notification directly to us, together with the evidence of the claim and the corresponding serial number of the SOLAR PANEL(s) and the relevant invoice. We will not accept the return of any PV-solar panels unless we have given written authorization in advance.

6. Severability
In case that a part, provision or clause of this "Limited Warranty for PV Solar panels", or the application thereof to any person or circumstance, is held invalid, void or unenforceable, the other parts, provisions, clauses or applications of this "Limited Warranty for PV Solar panels" are still valid.

7. Disputes
In case of any discrepancy in a warranty claim, we will submit it to a first-class international test-institute such as TüV SUD / Germany, for arbitration. All fees and expenses shall be born by the losing party, unless otherwise awarded. SHINE holds the final explanation right.

8. Various
The repair or replacement of the SOLAR PANELS or the supply of additional SOLAR PANELS does not Cause beginning of new warranty terms, nor shall the original terms of this "Limited Warranty for PV-Solar panels" be extended. Any replaced SOLAR PANELS shall become the property of SHINE and we have their right of disposition. SHINE has the right to deliver another type which may differ in size, color, shape or power from the original one, if we no longer produce the replaced SOLAR PANELS at the time of the claim.

9. Force Majeure
SHINE shall not be responsible or liable in any way to distributors or ultimate customers when the non-performance or delay in performance of any terms and conditions of sale, including this "Limited Warranty for PV Solar panels", is caused by disasters, war, riots, strikes, and any unforeseen event beyond its control, including, without limitations, any technological or physical event or condition which is not reasonably known or understood at the time of the sale of the SOLAR PANELS or the claim.

10. Validity
This "Limited Power Warranty for PV Solar panels" is valid for all SOLAR PANELS dispatched from 1st JUNE 2007 to 31st December 2012.
